Passat sport - recall on blocked drain holes?

Ref: R ecall blocked drain holes.

Following a recall I booked my car into a recommended Volkswagon garage, they cleared the leaves from the drain holes - I had performed the same task only the week before after the battery and servo unit was 50% submerged in water. The recall was based on the potential for water to get into the Servo unit. When < 0 frozen by brakes are now rock solid, I feel that water has got into the brake system and freezes due to this fault. The garage want to charge me £105/hr to fix.

Is Volkswagon liable, the car is 51 Reg ???
