You have to lift the handle up for the locking mechanism to engage into its keeps. This is how it is designed.

Sounds like the middle latch keep is not aligned properly you can first of all mark the correct position with a pencil and move the keep but there are many different reasons this could be happening one being your door has dropped and needs heel and toeing
