my rca m4208gr-b won't turn on. WTF?

i have an rca opal m4208gr-b and it won't turn on. i tried resetting it no go. tried firmware upgrade but it stays on the initializing page and it won't download. needless to say i'm pretty frustrated. anyone have any ideas?

I think the battery is dead and will not charge and when it is plugged into a usb power source, it does a basic powering and will shows up as a flash drive on a computer because it is being powered by the usb port and will say initializing, however it does not have enough power in the battery to power up and work.
